Massachusetts Bay Asserts its Right to Govern, 10 June 1661

  • Regarding Liberties
    • We conceive the patent to be the first & main foundation of the local civil polity by the Governor & company
    • The Governor & company are by patent & name a body politic
    • The body politic has the power to make freemen
    • The Freemen have the power to choose annually a Governor, Deputy Governor, Assistants & representatives/deputies
    • The government has the power to establish officers & establish their powers & locations
    • Governor, Deputy Governor, Assistants & representatives/deputies all have full power & authority, legislative  & executive, for the government of the people here, be they inhabitants or foreigners, in church & civil matters, without appeal except in cases repugnant to English law
    • The government of the people is privileged by all means to defend itself by land & sea against those trying to destroy, invade or bother the people, land or government
    • Any imposition prejudicial to the laws established, not repugnant to English law is an infringement on the people’s right
  • Regarding Duties of Allegiance to the King
    • We ought to uphold & maintain power to maintain the territory as belonging to the King & not subject to foreign kings
    • We ought to preserve the king’s power, realms, dominions, etc. & to prevent any plot against him or his government
    • We ought to seek peace & prosperity of our king & his nation by using the government:
      • To punish all crimes committed against the peace of the king
      • To propagate the Gospel, defend the True Christian, Protestant religion according to the faith given to us by Christ in his word. Our sovereign is styled “Defender of the Faith”
  • The territory will succeed with the loyalty & obedience of the king’s subjects. There may be cases where subjects may need to plead with the king where their privileges have been violated
